These Terms & Conditions apply to all Adapt Courses, including but not limited to Functional Blood Testing, Functional Nutrition Mastery, and Functional Hormone Mastery.
1. Payment Terms
By registering for an Adapt Course, you agree to provide a valid credit card to pay for the course in full, including all applicable taxes or fees.
You understand that payment provides you with 12 months of course access, starting from the date of registration, unless otherwise stated.
2. Refund & Transfer Policy
We want you to feel confident in your purchase. Because this is a digital, informational product delivered with instant access, the entire program is available to you immediately upon purchase. For this reason, we offer a 48-hour refund window.
Refund Eligibility
You are eligible for a full refund if:
- Your request is submitted within 48 hours of purchase, and
- You have accessed less than 30% of the course or downloadable materials.
Refunds will not be granted after:
- 48 hours have passed from the time of purchase, or
- You have accessed 30% or more of the content.
How to Request a Refund
To request a refund, email us at support@kresserinstitute.com with:
- Your full name
- The email address used at checkout
- A brief note stating that you are requesting a refund
If your request meets the criteria above, your refund will be processed within 3–5 business days.
All Sales Final After 48 Hours
After the 48-hour period, all sales are considered final. Because this is a digital product with immediate access to proprietary educational materials, no exceptions will be made beyond this window.
Enrollment in the Course is non-transferable. Your spot may not be given to another student, nor may you transfer into another course.
3. Removal from the Program
Kresser Institute may dismiss or revoke a student’s enrollment without a refund for violating the ADAPT Code of Conduct.
Violations of Section 1.5 are grounds for immediate dismissal. Other violations may result in warnings, as outlined in Section 4, but may escalate to dismissal if the behavior does not improve.
We also reserve the right to suspend or terminate your enrollment without refund if you:
- Violate these Terms,
- Engage in disruptive, unethical, or harmful behavior, or
- Misuse or share course content without authorization.
3. Affiliate Disclosure
Products and services recommended in the course are limited to those that faculty use with patients. Some course materials may include affiliate links, which means O’Shea Functional Health, Inc. may receive a commission if you purchase products or services using those links. This comes at no additional cost to you.
4. Course Participation Acknowledgment
By completing my registration for the Adapt Functional Nutrition Mastery Course, you acknowledge and agree that:
- The information you provided regarding your education, training, and experience is true and accurate.
- You have read the course informational page.
- You understand who the Course is (and is not) designed for and what it prepares participants to do.
- The Course is not intended as a substitute for professional training, certification, accreditation, or licensing.
- You are either
- a credentialed healthcare practitioner,
- employed by a healthcare professional, or
- someone with sufficient training and experience to qualify for the program
- This is a self-study course, and there is not typically an option to ask Tracey O’Shea or any other instructors questions about the course content.
- This course is for educational purposes only and is not a substitute for medical care provided by a licensed healthcare provider.
- The education provided is general in nature, based on scientific research and clinical experience, and does not constitute individualized medical advice.
- Any dietary changes, supplements, or other interventions discussed in the course are not individualized or personalized recommendations, and that a healthcare provider should be consulted before adopting them.
- Your participation in the course does not fulfill any licensing requirements or expand your professional scope of practice, nor does it authorize you to render care, prescribe regimens, or prescribe medications or supplements.

5. Intellectual Property
All course content—including but not limited to text, videos, graphics, handouts, and downloadable materials—is the intellectual property of O’Shea Functional Health, Inc. and is protected by copyright and other applicable laws.
You may use these materials for personal learning only and agree not to reproduce, distribute, share, sell, or publicly display any part of the content without written permission.
6. Account Use
Your course login and account access are for personal use only. You agree not to share your login credentials or allow others to access the course under your account. Unauthorized sharing or distribution may result in termination of access without refund.
7. Termination of Access
O’Shea Functional Health, Inc. reserves the right to suspend or revoke access to the course, without refund, if you violate these Terms or engage in behavior deemed disruptive, unethical, or harmful to other participants or instructors.
8. Technical Availability
We make reasonable efforts to ensure continuous access to course materials. However, we do not guarantee uninterrupted or error-free service, and we are not liable for temporary unavailability due to maintenance, updates, or technical issues.
9. Disclaimer of Warranties
The course and related materials are provided on an “as is” and “as available” basis without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or accuracy of information.
No guarantee is made regarding specific outcomes or results from participation in the course.
10. Limitation of Liability
To the maximum extent permitted by law, O’Shea Functional Health, Inc., its instructors, and affiliates shall not be liable for any direct, indirect, incidental, or consequential damages arising from my participation in the course or reliance on course materials. Your sole remedy for dissatisfaction with the course is to discontinue participation and request a refund within the stated refund period.
11. Privacy and Data Use
Your personal information will be collected and processed in accordance with the Privacy Policy. By enrolling, you consent to the collection and use of your information as described in that policy. We respect your privacy and will never sell or disclose your personal data except as described in that policy.
12. Dispute Resolution
Any dispute or claim arising out of or relating to these Terms or your participation in the Course shall be resolved through binding arbitration in California, in accordance with the rules of the American Arbitration Association.
Each party will bear its own costs, and the decision of the arbitrator shall be final and binding. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction.
13. Force Majeure
Kresser Institute shall not be liable for any failure or delay in performance caused by circumstances beyond its reasonable control, including but not limited to natural disasters, acts of government, labor disputes, internet outages, or equipment failures.
14. Entire Agreement
These Terms, together with our Terms of Service and Privacy Policy, constitute the entire agreement between you and Kresser Institute with respect to your participation in the Course and supersede all prior understandings or communications.
15. Registration Acknowledgements
By enrolling in the course, you confirm that I have read the informational page, understand what the course entails, and agree to abide by these Terms & Conditions.
